Marty explains to Cole what Todd did to her while they were in college; Cole wants to know why Todd isnt in jail still. Marty explains that Todd convinced a judge that he has changed; Marty admits too that she believes that Todd couldnt rape anyone again. Marty also explains that she feels Todd could hurt someone just the same now as before. Cole opens up to his mom, explaining that hes been on steroids since the summer and only took them so he could be better at football. Marty can see that he is still distraught and explains that he needs to seek the same forgiveness from Starr as Todd did from her. David taunts Spencer about his upcoming sentencing positive that Spencer will go to jail. Spencer explains that he never looses anything; David reminds him that he lost Blair. Van scolds David for talking to Spencer, explaining that he could cause a mistrial if he lets something slip. David backs off and waits to be called to the stand.
Nora and Bo congratulate Van on a firm and well prepared opening statement. Van can now prepare on putting Spencer away for a while. The judge returns from recession, Van calls David to the stand. David explains everything that happened the night Thomas McBain was shot, identified the weapon that Spencer used and identified in a picture that Spencer was in possession of the gun. Mark, Spencers lawyer, tries to discredit David by bringing up Davids lying habits and his inability to stay out of prison. The judge calls for another recess; Van calls Blair and tells her to get to the courtroom ASAP. Meanwhile, Blair and Todd are talking about what happened with Starr. Todd feels inadequate about not being able to protect his children Jack wont even look at him, Starr is scared of him and he has a son whom he may never meet. Todd explains that hes basically giving up. Blair goes off on him saying that he never gives up that easily and if he is going to give up she wants him out of the house and away from the kids.
Todd starts to leave, Starr rushes downstairs and tells Todd not to go. Blair gets Vans message and rushes to the courthouse. Todd sits with Starr and has a talk with her, Starr explains that she is scared of Todd not because of what he did, but because Starr fears that Todd will leave them again. Todd explains that he is never going to leave them; Starr warms up a little to him. Todd explains that there is something he has to do and makes Starr promise shell be there when he gets back. Todd takes off, Cole shows up. Starr refuses to let him in; Cole explains that hes not going anywhere until she lets him in. Todd goes to the principal of Llanview High, Wexler, and wants Cole expelled. Marty overhears this and explains that if Todd goes after Cole she will go after him. The judge returns from another recess, Van calls Blair up to the stand just as she walks into court. . .
Jess and Antonio are on their honeymoon in Puerto Rico, they dance to a traditional Puerto Rican song but are interrupted when Jess thinks that she sees Nash. Jess shakes off the image and continues to dance. Rex and Adriana are at Rodis; Rex still contemplates telling Marcie, Mike and Todd about the baby. Adriana wants to go home and talk about it; they run into Roxy who wants them to stay. Adriana explains they have things to do, they leave. Roxy runs into Nash and Bree. Nash explains that Jess and Antonio are on their honeymoon, Roxy can see that Nash is still hooked up on Jess and tells him that it might be a good idea to forget her. Nash reminds Roxy that he was never in love with Jess, he loved Tess. Roxy quickly changes the subject; she sees Nash drinking wine and asks him to give her a lesson in wine tasting. Nash does so; in the process he has a flashback of when he was teaching Tess how to taste wine. Rex and Adriana return home. Rex is lamenting over whether or not to tell anyone about Tommy. Adriana asks what he would do if he didnt know the parties involved. Rex explains that, if he didnt know who the people were, he would tell who ever paid/hired him first.
Blair takes the stand, Van asks her a series of questions about when the first time she met Spencer and how their relationship evolved. Blair gets lightheaded and passes out; Mike rushes to her side and escorts her out of the courtroom. Spencer seems genuinely concerned, Mark explains that it would be better for them if Blair didnt return because she could do some damage to their case. Spencer explains to Mark that he still loves Blair and threatens him if Mark should say anything negative about Blair again. The judge calls for recess.
